Unpaid Internship Landscape in Australia
While in America and many European countries internship programs (paid and unpaid) are a dominant feature of the employment industry, in Australia, it is still not as developed. Hence, there is a lot of apprehension and confusion around legalities and structure of a successful internship program. In 2010 only about 19% students enrolled in Australian Universities had completed some form of an internship program. (Ref. Clara Jordan-Baird, ‘Experience Essential, Remuneration: None,’, Centre for Employment and Labour Relations Law, The University of Melbourne, June 2013.) This number in 2015 had sharply risen to 58% according to a controlled study done by Internship Australia. Even though the sample size of the 2015 study was not large it gave a clear indication that Australian businesses and students were warming up to the benefits of internships.

Why the steady rise in Internship seekers?
As internships are becoming a common feature of the Australian employment landscape, it has resulted in a widespread view that they provide an opportunity for a job seeker to connect with a potential employer, demonstrate value and leverage the internship to secure an offer of paid employment. With Australia’s jobless rate reaching 7.5% in July 2020 and Economist Sarah Hunter pointing out that the national effective unemployment rate is 9.3% an internship is being seen as a better alternative path to a job by many students. For host companies too it is an effective way of hiring fresh graduates as it gives them a chance to evaluate their, engagement levels, performance and several competencies while the student gains valuable job work experience. Hence, we believe internship programs will continue seeing growth in the years to come and companies will continue benefiting from an effective internship program.
Is Unpaid Internship legal in Australia?
Unpaid Internship is allowed in Australia if it is a vocational practice or an employment relation doesn’t exist between the intern and the host company. Several criteria need to be considered to determine that an employment relation is not created (details in the section below)
Internships should be of short periods of a definite length of time. Most ECA Internship managed host companies go with a 3-week or a 12 week program.
A longer duration unpaid internship is possible if it a vocational placement. For the program to be considered as a vocational placement, it must be a requirement of an educational or training course. Such placements will also need to be approved. (where approval is under a law or an administrative arrangement of the Commonwealth, a State or a Territory, which will include courses offered at universities, TAFE, schools or other bodies authorised to offer registered training courses
What is an employment relationship?
It is important to note that there is no definitive test to what constitutes as an employment relationship and it will vary on a case to case basis. However, below are some key considerations that point to an employment relationship:
A person to be considered an employee must be engaged under a valid contract.
The purpose of the internship, what benefits does the host company obtain (in terms of productive work versus training and skill development) and what benefits does the intern obtain. The more productive the work the more likely an employment relationship has been established.
The intern is directly involved in work that benefits the business, especially if the business is charging for or making a profit from the work done by the intern.
The length of the relationship plays a key role, the longer the term the more likely that an employment relationship has been formed.
Whether the intern is receiving meaningful learning experience, training or skill development from the program. If not, then an employment relationship has been formed.
The business offering internship has several interns performing the same task. In such cases even if single internship does not constitute of forming an employment relationship, the business could be seen as an employer due to the number of interns. To avoid the situation your internship program will require to have clearly defined activities for each of your interns.
Ensure intern understands it is voluntary experience, i.e. freedom of choice to take up internship (and no guarantee of any outcome, including employment, if do/do not take up internship)
Ensure intern understands is unpaid (confirm in writing, and make sure that any promotional/advertising makes it clear up front the position is not paid). Ensure that the program provides a genuine training opportunity

Compensation
Should you pay your interns? This is an important question, possibly affecting the direction of your whole program.

Recruitment
Where do you find the best internship candidates? You should be looking for ambitious and driven college students and new graduates. Often the best way to do this is to attend a related college class as a guest speaker. This gives you face time with the students as well as academic advisors and professors who can share internship information with other students.
Make sure you list your programs on all job boards and you participate in offline college events, career fairs and use LinkedIn to spread the word about the internship. The smaller your business is the tougher it is to attract the right candidate. So, do consider teaming up with one of the job boards to help you promote your internship and do all the leg work.
The internship description, learning outcome for students and expectation from the role must be mentioned clearly. As you accurately and positively share these details, you’ll hopefully attract a large pool of applicants and consistent pipeline of potential hires.
Have a Program Coordinator
Having a person in charge of your interns is crucial to building a program that pushes candidates and ensures they’re getting the most out of their experience. The best part is, for small businesses, this position doesn’t need to be a separate full-time position. Also, this person can help your HR during the recruiting process as they will be able to sell the program more passionately to young minds.
Internship coordinators can build a program that ensures your interns are have a collective learning experience. From teaching business topics to giving career advice and training the interns to be successful at their job, a good intern coordinator will help interns to get the most out of the program. Create an Intern Toolkit

An effective toolkit is based on the questions interns ask their managers —Answer these questions for them. Also, empower them with resources and contacts so they can find information on their own.
Make sure the toolkit reflects your organization—Ensure that the toolkit represents your organization’s culture, mission, and values.
Keep it fresh—Update your toolkit at least once a year so it will have the most current information and can include answers to new questions or requests that your interns and managers have.
Mentor
Providing a mentor means giving interns an avenue for personalized feedback on matters that extend beyond their work. You want to provide a dynamic feedback experience for the intern, as they will get feedback from their program coordinator and their boss you would ideally want to assign a junior level employee as a ‘mate’ to create a relaxed informal relationship that promotes professional growth and development. If your team is not that big then the program coordinator can play this role too. However, one must remember interns require a bit of nurturing.
Goals
Setting goals for your interns and revisiting their progress throughout their tenure is another important step in development. Interns will work on two or three major projects, depending on the length of their internship. The key is tracking their progress and making sure there’s a defined beginning, middle, and end to their work.
Feedback
Feedback from students about the program after they complete their time at the business will help you further build on your program. The insight can yield information about how the interns perceive your company and how their experience was. The better their time was at your company the more likely they are to recommend it to their friends.

Personal branding is a daunting task even for the best of us and figuring out where to start is the toughest part. So here is some tips that you can implement from day 1 and see your personal brand grow and help you achieve your goals. Whether the goal is to be selected for your dream internship or get noticed by the company you would like to work for in the future.
GET A PROFESSIONAL HEADSHOT
The first thing you would want to do is ask your mate or mother or anyone for that matter to click a decent headshot for you. Squinch, smile and dress sharp to look good in the shot. Think of who you want to be in next 5 to 10 years and dress like that person. If you are a business major looking to work for an accounting firm or human resources put on a suit. If you a communication major looking to work in PR or advertisement you can be a bit more casual. Just don’t look sloppy or use a picture from your birthday or a party!
The backdrop of the picture should be simple, flat color or blurred out work the best. Don’t get to much into the details, I don’t want you to procrastinate!
BE DISCOVERABLE ONLINE
Bring social media to play and be discoverable. Think of the social media platform that is relevant to you and make sure you keep it professional. If you are a fine-arts major, you would want to have a presence on Instagram and pinterest. You would thus want to keep these accounts free of your drunk party pictures or any other picture you wouldn’t want to share with you parents! Curate your Instagram page with your work or work of other people (don’t forget to give credit) that you like. This will give people looking at your page an insight into your mind. If you are a business or an engineering student having a presence on Linkedin is a must. You may or may not want to maintain a professional Instagram page. If you have a personal Instagram page make it private. Think of social media as your CV, only put up things that will help people understand you. Remember, there is no point having an account on all social media platforms out there if you are not engaging on it.
A mission and a vision statement are not just for companies. Define your own purpose, mission and vision statement. Write it on a piece of paper and stick it on your desk. This will not only help you stay on track but also work as a litmus test when you are confused. Think of what gets you out of the bed in the morning, what are you passionate about. A professional purpose will get you excited about your future. Pay check shouldn’t be the only reason to get a job!
To have a well-rounded personal brand, you need to strike a balance between what you know and what you have yet to learn. Don’t be afraid to reach out and connect with people you want to learn from. Ask for their time, if they live in your city try and meet them for a cup of coffee. You will be surprised by just how many people might actually say yes. Constantly, grow your network, meet or connect digitally with people who you want to be like. This will deepen your understanding about your field and open up a world of opportunities.
PRACTICE WRITING
“Be sure to taste your words before you spit them out” Okay, now that’s a tad overboard but think before you jot down and share online. Even though you can delete and edit most of the time, you still wouldn’t want to come across as brash. Some age-old sayings still hold true today, it is just that most don’t realise it. “Never talk about religion, politics or money at family gatherings because it will end it a fight.” This is as true for family gathering as it is for the internet. As far as possible stray away from these topics unless you are majoring to be an expert in the subject. When posting publicly one needs to always think about how your post can affect someone, globally.
ANALYSE YOUR COMPETITION
You might be the best in your college or your school. But in this connected world that we live in today, your competition might not even be in the same city or continent as you. So, always keep your eyes open. What are other students with your background from around the world doing. Courses they are taking, companies they are interning for, initiatives they are a part of. This will help you realign your priorities. Many a times we don’t look beyond our circle of comfort and pretend we are doing fairly well. Look beyond to get inspired.
CREATE VALUABLE CONTENT
Students can benefit from sharing their thoughts via podcasts, Medium articles, or curated Instagram feeds. Focus in on your long-term goals and then reverse-engineer a plan for the kind of content you want to create. For example, I am building a career in digital marketing, so my plan is to write about the latest social media trends.
Young people often feel like they don’t have enough life experience to build an audience, but that’s a misconception. Youth are excellent communicators – just think of all the teenage YouTubers and Instagrammers who are followed by millions. Whether you want to write on Medium or podcast via Spotify, there are already students leveraging that platform. With enough planning, you can use your youth to your advantage and develop your own niche perspective. Youth are creating valuable content every single day, and you too can build an audience online.
BUILD YOUR NETWORK
Another important aspect of personal branding is building key relationships. When you take on a new internship, it’s your responsibility to shake hands (or touch elbows, thanks to 2020) and talk to co-workers around the water cooler. University isn’t just for learning about calculus; it’s also about making contacts that will one day land you a job.
Many students are complacent about their network. They think that they don’t know anyone and therefore they don’t feel comfortable attending networking events. Whether you enjoy it or not you need to start. It will only get easier.

Set up alerts for trends and news of your industry. Constantly read. This will help you form opinion and subject matter expertise. At the end of the day you need to know about the sector you wish to work in. It will help you hold meaningful conversations with your network.
